    • Conflict. If the meaning of any general term conflicts with any other relevant specific term, the specific term will apply. Specific terms apply to a specific section of the website or have been specifically agreed between you and us.

Some of these services include: The Community Policing Forum, security companies, The SPCA, ambulance services, fire and rescue services, other organisations, community members and service providers.

  8. Intellectual property

    • Without completing a subscription cycle for Safe Community's services, your visit to the website shall not:
      • constitute or give rise to any agreement between Safe Community.
    • Safe Community reserves the right to refuse to accept and/or execute a subscription for Safe Community's services without giving any reasons therefore. Safe Community also reserves the right to cancel subscriptions for Safe Community's services in whole or in part in Safe Community's sole and absolute discretion. Safe Community shall only be liable to refund monies already paid by the user.
    • Payment security: We use firewalls, SSL and industry standard security measures
    • Negotiation: Should a dispute arise between a user and Safe Community, each party must make sure that their chosen representatives meet within 10 business days of notification, to negotiate and try to end the dispute by written agreement within 15 more business days.
    • Mediation: If negotiation fails, the parties must refer the dispute to mediation under AFSA's rules.
    • Arbitration: If mediation fails, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator's decision) under AFSA's latest rules for expedited arbitrations. The arbitration will be held in English in Cape Town. The parties will agree and appoint one arbitrator. If the parties cannot agree on the arbitrator within 10 business days after the referral, the Secretariat of AFSA will appoint the arbitrator.
    • Cooling-off period: A user has the right to return goods or services purchased from this site within 7 days if such goods or services are not listed in section 42 of the Electronic Communications and Transactions Act No. 25 of 2002. This right does not extend to the following goods and/or services:
      • for financial services, including but not limited to, investment services, insurance and reinsurance operations, banking services and operations relating to dealings in securities;
      • by way of an auction;
      • or the supply of foodstuffs, beverages or other goods intended for everyday consumption supplied to the home, residence or workplace of the consumer.
      • for services which have begun with the consumer's consent before the end of the seven day period referred to in section 45(1);
      • where the price for the supply of goods or services is dependent on fluctuations in the financial markets and which cannot be controlled by the supplier;

        • are made to the consumer's specifications;
        • or clearly personalized;
        • by reason of their nature cannot be returned; or
        • are liable to deteriorate or expire rapidly;
        • where audio or video recordings or computer software were unsealed by the consumer;
        • for the sale of newspapers, periodicals and magazines;
        • for the provision of gaming and lottery services; or
        • for the provision of accommodation, transport, catering or leisure services and where the supplier undertakes, when the transaction is concluded, to provide these services on a specific date or within a specific period.
    • The user has the right to review, correct and cancel electronic transactions before the user effects payment.
    • The user may lodge a complaint at the Consumer Affairs Committee, as the case may be, if this site does not comply with Chapter VII of the Electronic Communications and Transactions Act and/or this agreement.
    • By using this website or communicating with Safe Community by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be "in writing".

  9. Agreements in terms of section 21 of the Electronic Communications and Transactions Act

    • No information or data on this website is an offer, but merely an invitation to do business.
    • Merely sending a data message to this website shall conclude no agreements or its owners, valid agreements are only concluded as detail above.
    • Data messages, such as e-mail, are only deemed to have been received by Safe Community once reply to and such a reply does not include an auto-reply.

  12. Disclaimer and limits to our liability

    • Subject to the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act, Safe Community shall not be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this website or the services or content provided from and through this website. Furthermore, Safe Community makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this website are free from errors or omissions or that the service will be 100% uninterrupted and error free.
    • This website is supplied on an "as is" basis and has not been compiled or supplied to meet the user's individual requirements. It is the sole responsibility of the user to satisfy itself prior to entering into this agreement with Safe Community that the service available from and through this web site will meet the user's individual requirements and be compatible with the user's hardware and/or software.

This policy complies with the principles contained in the Electronic Communications and Transaction Act 25 of 2002 (ECT), for electronically collecting personal information and the right to notify data subjects on how we handle personal information given to Safe Community as per the Protection of Personal Information Act 4 of 2013 (POPIA) The purpose of this policy is to describe the way we collect, store, use, and protect information that can be associated with a specific natural or juristic person and can be used to identify that person ("personal information").

We will disclose the transfer on the website/app. If you are concerned about your personal information migrating to a new owner, you may request us to delete your personal information.

Our hosting company will host our website/app in a secure server environment that uses a firewall and other advanced security measures to prevent interference or access from outside intruders. Personal information may be stored on servers located outside South Africa in a foreign country whose laws protecting personal information may not be as stringent as the laws in South Africa. You consent to us processing your personal information in a foreign country whose laws regarding processing of personal information may be less stringent.

    You may choose to correct or update the personal information you have submitted to us, by clicking/selecting on your profile in our app or by emailing info@safecommunity.co.za.

    We acknowledge that you can participate in the personal information that we have on record. When you provided adequate proof of identity, you may request a record of the personal information we hold. We will in turn provide you with the said record within a reasonable time. You may make a request by viewing your profile in the app or by emailing info@safecommunity.co.za.

  15. Accountability
    We are accountable for the possession, safekeeping and usage of your personal information and agree to put in place all reasonably practicable policies to ensure the personal information is used only for its intended purposes, safeguarded from fraudulent activity and discarded in a safe and legal manner.

    We are not responsible for, give no warranties, nor make any representations in respect of the privacy policies or practices of linked or any third party websites.
